These Terms apply to every purchase of products from Resin Source, LLC. Please read them before paying. By paying for product, or by taking delivery of product, the customer accepts these Terms.
Resin Source does not extend credit and does not offer payment terms of any kind. Each order must be paid in full before the product is released to the Customer.
The Customer shall inspect each kit at the time of delivery. The Customer's signature on the delivery receipt or invoice is the Customer's acceptance of the count and of the external and packaging condition of each kit, and risk of loss and responsibility for the product then pass to the Customer. The chemical integrity of the product is covered only by the warranty terms below.
Unaltered, unopened product may be returned to Resin Source within thirty (30) days after delivery for a refund of the price paid. The Customer is responsible for the cost of return shipping. Product that has been opened, altered, or used, or that is returned after the thirty (30) day period, is not eligible for a refund. This return policy applies to all products purchased from Resin Source.
Resin Source warrants only that each kit of product, as delivered, conforms to the chemical specification stated in its Technical Data Sheet (TDS). This is the only warranty Resin Source provides.
Before installing or otherwise using the product, the Customer must perform a field cure-test on a small, measured sample — confirming gel time, set, and cure against the TDS — and must create a dated record of that test that includes photographs. Installing or otherwise using the product without a documented, dated pre-installation field cure-test voids any warranty claim for that product. If the field cure-test passes, no warranty claim is available for that product.
If a field cure-test fails, the Customer must not install or further use the product and must return it to Resin Source, with the remaining product substantially intact, within fourteen (14) days after the failed test. Resin Source will chemically test the returned product and compare the result against the manufacturer's dated chemical-test record for that batch. A claim is upheld only if that testing confirms the product is genuine Resin Source product that left the manufacturer not conforming to its chemical specification. A claim is denied if the testing shows the product conformed to specification, or shows the product was altered, diluted, contaminated, or otherwise tampered with after it left the manufacturer.
If a claim is upheld, Resin Source's only obligation — and the Customer's sole and exclusive remedy — is, at Resin Source's option, either replacement of the non-conforming product or refund of the price paid for it. Resin Source is not responsible for labor, removal, tear-out, re-coating, downtime, lost profits, or any other cost, loss, or damage.
Except for the limited chemical-integrity warranty above, product is sold “as is.” Resin Source disclaims all other warranties, whether express, implied, or statutory, including the implied warranties of merchantability and fitness for a particular purpose, and any warranty of performance, adhesion, durability, appearance, longevity, or installed result.
The performance and longevity of a coating depend overwhelmingly on installation-stage factors outside Resin Source's control, including surface preparation, grinding, slab moisture, ambient and surface temperature, mixing, and recoat timing. The Customer is solely responsible for installation and for the installed result.
Resin Source's total liability arising out of or relating to the product or these Terms will not exceed the price the Customer paid for the product giving rise to the claim. Resin Source is not liable for any indirect, incidental, special, or consequential damages, or for lost profits or lost time.
These Terms are governed by the laws of the State of Texas. The exclusive venue for any dispute is the state or federal courts located in Travis County, Texas.
The field cure-test must use no more than one-quarter (1/4) gallon of product. The Customer must record the weight of the product immediately before and immediately after the field cure-test, and must provide both recorded weights to Resin Source when the product is returned. A warranty claim is not valid unless both the before and after weights are provided.
